Should I declare bankruptcy?
Bankruptcy is an extreme measure and is usually only a last resort. The best first step when considering bankruptcy is to speak with a debt relief professional and explore all available options. Often times, a debt situation can be resolved without filing for bankruptcy.
What should I do if a company I owe money to sues me?
You should speak to an experienced debt & credit attorney as soon as possible. Typically, you will need to respond to the lawsuit within 30 days. If you do not properly respond, your creditor will likely seek a default judgment. This would allow them to win automatically. Therefore, it is imperative that you speak to an attorney with experience handling creditors as soon as you have been sued.
How long will it take to resolve a debt lawsuit?
The short answer is that it depends. It can take as short as a few months or as long as a couple years depending on the circumstances of the case. The good news is that while the lawsuit is pending, you can use the time wisely and save up money. If you can save enough, you may be able to offer a lump sum to your creditors to pay off the debt all at once. However, this is not always the case and depends largely on your creditor and their attorneys.
Do I owe money if I am the victim of credit fraud?
Generally, no. Victims of true fraud still need to go through the legal process to have the fraud ruled on by a judge. Usually, such cases do not lead to you owing money. Even so, it is important to speak to a professional about fraud as a potential defense to your debt case.
